1. Overview
These Terms of Service (“Terms”) govern your access to and use of Analyttica’s LEAPS platform (also referred to as “ATH” or “Analyttica Treasure Hunt”), including any products, services, applications, websites, and related tools, solutions, or features (collectively, the “Services”). By accessing or using the Services, you agree to comply with these Terms. If you do not agree, please refrain from using the Services.
These Terms form a legally binding agreement between you (“User,” “you,” or “your”) and Analyttica (including its successors, subsidiaries, affiliates, and assigns). References to “including” or “for example” are illustrative and do not limit the scope of the statement.
2. Introduction
2.1 Agreement & Applicability
These Terms incorporate by reference our Privacy Policy and Intellectual Property Policy, which outline how we handle data, privacy, and intellectual property. Together, these documents constitute the entire understanding regarding your use of our Services. Whether you are a Third-Party Provider or a Site User/Visitor, these Terms apply equally to you.
2.2 Legal Age & Acceptance
By creating an account or using the Services, you confirm that you are of legal age to form a binding contract. If you are not of legal age, you may only use the Services through a parent or guardian’s account (if applicable law permits). If we discover that an account violates these rules, we may terminate it without notice.
2.3 Binding Arbitration & Class Action Waiver
By using the Services, you agree to binding arbitration for dispute resolution and voluntarily waive certain rights to participate in class actions, as further detailed in Section 19.

4. Definitions
- “Services”: All products, platforms, applications, websites, abilities, integrations, and solutions provided by Analyttica (e.g., data analytics tools, AI services, BI services, ML capabilities, hackathons).
- “Platform”: The LEAPS platform, enabling users to learn, apply, and solve data-driven exercises using ML and AI functionalities.
- “User” or “You”: Any individual or entity accessing or using our Services.
- “Third-Party Technologies”: External tools, software, or services integrated into our Services (e.g., open-source libraries, APIs, ML/AI models).
- “Personal Data / PII”: Information identifying or linkable to an individual, such as name, email, and phone number.
- “Content”: All software, technology, designs, data models, templates, dashboards, case studies, business use cases, workflows, reports, code, educational materials, text, graphics, audio, video, images, animations, illustrations, ideas, user submissions, community posts, recommendations, or other materials made available through the Services. This includes both the individual elements and their arrangement. Content can be created by other users, third parties, and Analyttica.
- “User Content”: Any data, text, code, analysis, visualizations, or other materials you create or upload via the Services.
5. Changes to the Terms
Analyttica reserves the right to update or modify these Terms at any time to reflect changes in our Services or legal requirements. When such changes occur, we will post a notice on our website or use other communication methods. The revised Terms take effect immediately upon posting.
By continuing to use the Services after the updates become effective, you accept the updated Terms. If you do not agree, you must stop using the Services. Unless otherwise described herein, any modifications or amendments must be in writing and mutually agreed upon by both you and Analyttica.
6. Account Registration & Responsibilities
To use certain features of our Services, you must create an account by providing accurate, complete, and current information and keep it updated.
- Security: You are responsible for all activity under your account. Do not share your login credentials; notify us promptly of any security breaches.
- Multiple Accounts Prohibited: You may not control more than one active account for participation in competitive events or hackathons. If we detect duplicates, we may revoke access without notice.
- Lawful Use: You must not engage in fraudulent activities, impersonate others, or use the Services for any illegal or unethical purposes.
- Suspension or Termination: Analyttica may suspend or terminate your account for violations of these Terms or other reasons (e.g., prolonged inactivity, misuse, or unethical behavior).
- Personal, Non-Commercial Use: Unless specifically authorized, you will use the Services solely for internal, personal, or non-commercial purposes.
- No Transfer: You may not transfer your account or use someone else’s account at any time without our prior written permission.
7. Data Ownership & Usage
7.1 Your Data
You retain ownership of any data or content you upload, provided you have lawful rights to do so. By using our Services, you grant Analyttica a non-exclusive license to process and analyze your data to provide, enhance, and personalize the Services.
7.2 AI Models & Proprietary Algorithms
Analyttica’s proprietary AI/ML models, algorithms, and frameworks remain our exclusive intellectual property. You may use them under these Terms but must not reverse-engineer, duplicate, or resell any aspect of these technologies.
7.3 User-Generated Content License
By creating dashboards, analytics, learning content, community posts, or other “User Content,” you grant Analyttica a non-exclusive, worldwide, royalty-free license to use, display, and perform such content as needed to operate and improve our Services. If you submit solutions, code snippets, or data sets for collaborative or educational purposes, you acknowledge other users may see or access them depending on your privacy settings.
7.4 Data Ethics & Protection
Use the Services in compliance with all data protection regulations and ethical guidelines. Do not upload content that violates privacy or intellectual property rights. In particular:
- Avoid Sensitive Data: You must ensure any data you upload does not contain personally identifiable information (PII) unless anonymized or legally allowed.
- Confidentiality: You are responsible for ensuring you have appropriate rights or permissions to upload any data. We disclaim liability for any improper upload or distribution by users.
8. User-Generated Content & Community Guidelines
8.1 Content Responsibility
You alone are responsible for any content you upload, post, or share. You represent that you have the rights to submit such content and that it does not infringe on third-party rights.
8.2 Prohibited Content
Do not upload material that is harmful, unlawful, threatening, abusive, defamatory, obscene, or fraudulent. Analyttica reserves the right to remove such content and may terminate your account for violations.
8.3 Community Spaces
When you participate in our community features (e.g., forums, chat rooms), you grant Analyttica a license to display your posts within these spaces. You must not redistribute or share other users’ community posts outside of these spaces without explicit permission. You further acknowledge that anything you post is at your own discretion and risk.
8.4 Fair Use & Integrity
Do not cheat, spam, harass others, or undermine the integrity of our community. We reserve the right to remove any content or user if misconduct is detected.
- Academic or Educational Purpose: Unless explicitly stated, using the platform content or community discussions does not confer academic credit beyond those the Services specifically provide.
- No Unsolicited Advertising: You may not share unsolicited promotions, chain letters, or marketing content that disrupts community discussions.
8.5 Demo & Trial Usage
- Some users may be granted access to a demo or trial environment to explore the platform. You acknowledge that:
- Demo environments are typically hosted on our (or a third-party) cloud outside your organization’s firewall.
- You must not upload any confidential or sensitive data (e.g., personally identifiable or business-critical data) in a demo environment.
- Access to any demo environment may be time-limited (e.g., 30 days).
- Analyttica disclaims responsibility for any data you voluntarily upload during a demo or trial period.
9. Third-Party Technologies
Our Services may integrate external technologies (e.g., APIs, open-source libraries, AI models). Their owners retain IP rights, and you must comply with any separate terms they impose.
- Data Processing by Third Parties: Data handled by third-party tools is subject to those providers’ privacy policies. Analyttica is not liable for their actions.
- Liability Disclaimer: We disclaim responsibility for damages or losses from third-party technologies. Review any applicable third-party agreements before using integrated services.
- Open-Source Software: Some components may be governed by open-source licenses. To the extent any open-source license conflicts with these Terms regarding your use of those specific components, the open-source license terms apply.
10. Security & Data Protection
Analyttica employs industry-standard physical, technical, and administrative safeguards (e.g., encryption, access controls) to protect data, but no system is perfectly secure.
- User Obligations: You must protect your account credentials and promptly inform us of unauthorized access.
- Privacy Policy: Your use of the Services also follows our Privacy Policy, explaining how we collect, use, process, and secure personal data.
- No Guarantee: We do not guarantee data will never be lost or compromised. You are responsible for maintaining your own backups where necessary.
11. Payments & Billing
We may offer free or paid features. If a free service becomes paid, you will be notified and may opt to continue with payment.
- Billing: Paid subscriptions may be on a monthly, quarterly, or annual basis. You agree to pay via a valid method and cover applicable taxes.
- External Gateways: Payments may involve third-party gateways; Analyttica is not liable for data breaches or losses once you leave our servers.
- No Academic Credit: Unless otherwise stated by an accredited institution, using paid or free features does not grant academic credit.
12. Refund & Cancellation Policy
You may terminate a subscription by ceasing use of the Services and deleting any local copies. Confirm cancellation by emailing support@analyttica.com.
- Refunds: If eligible, we issue refunds for services not availed, as per our stated cancellation policies. Free trials follow these terms as well.
- No Returns: Educational or digital content delivered via the platform is intangible; therefore, no physical returns apply.
- No “Chargebacks” Without Cause: If you dispute a payment (e.g., via your credit card issuer) without a valid cause or without first contacting us, we may suspend or terminate your account at our discretion.
13. Termination of Services
13.1 By Analyttica
We may suspend or terminate your account for breaches of these Terms or other reasons (e.g., unethical behavior). In such cases, relevant data may be deleted, subject to our data retention policies.
13.2 Service Modifications
Analyttica may modify, suspend, or discontinue any aspect of the Services at our discretion. Paid users may receive credits or refunds at our discretion if a feature is discontinued.
13.3 Post-Termination
After termination, you lose immediate access to the Services. We are not liable for retaining your data, except where law requires or our internal policies dictate.
14. Competitions, Hackathons & Promotions
Analyttica may host or allow user-hosted competitions or hackathons. Additional rules (“Competition Rules”) may override these Terms in case of conflict.
- Region-Specific: Some events may restrict participants by geography.
- Team Participation: If permitted, each team member must follow these Terms.
- Final Decisions: Hosts’ rulings on winners or prizes are final.
- Disqualification: We reserve the right to remove or disqualify participants if misconduct is detected, including having multiple accounts or violating other Terms.
- Submission Ownership: You retain ownership of your submissions. However, by participating, you grant Analyttica or the event host certain limited rights to use and display your submission for the purpose of administering or promoting the event, as described in the specific Competition Rules.
- No Guarantee: Analyttica does not guarantee that participating in hackathons, competitions, or promotions will lead to specific outcomes like employment, funding, or partnerships.
15. User Representations & Warranties
You represent, warrant, and agree that you will not contribute any content, data, or user submissions, or otherwise use the Services or interact with them in any way that:
- Violates rights or creates liability
- Infringes or violates the intellectual property rights, data protection rights, privacy, or any other rights of any person or entity (including Analyttica).
- Creates or may create any legal liability for Analyttica, including through misuse of information or unauthorized use of the platform.
- Claims content you did not create as your own or fails to give proper attribution to copyright holders.
- Is unlawful, offensive, or harmful
- Uploads or shares unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable content.
- Harasses, impersonates, or misrepresents affiliation with any person or entity.
- Shares unsolicited or unauthorized advertising, spam, promotional materials, pyramid schemes, or chain letters.
- Contains malware, viruses, worms, spyware, or any other code that could damage or hijack system operations.
- Jeopardizes platform integrity or user safety
- Attempts to gain unauthorized access to another user’s account or security information.
- Shares login credentials or permits others to access your account.
- Attempts to reverse-engineer, decompile, or extract source code or data from the Services.
- Uses bots, spiders, scrapers, or other automated systems to interact with the platform without written consent.
- Tests or bypasses security measures or tampers with non-public areas of the platform or its infrastructure.
- Introduces spam or content that disrupts service or overwhelms servers or networks.
- Violates user and community trust
- Discloses personal information of other users or instructors without consent.
- Recruits instructors, users, or experts for external purposes without written permission from Analyttica.
- Submits content intended for commercial gain or competitive use without authorization.
- Uses the Services for any unlawful purpose or in violation of applicable laws or fiduciary obligations.
- Misuses educational nature of Services
- Uses user-submitted content or community discussion as professionally verified advice.
- Publishes platform-generated analytics or models as real-world insights without disclaimers.
- Encourages use of the Services for anything other than personal, educational, or non-commercial use unless otherwise explicitly authorized.
- Other prohibited actions
- Copies or stores any significant portion of platform content, or modifies/distributes it without permission.
- Shares content that is inappropriate for young users (under 13).
- Violates the Terms, community guidelines, or attempts to circumvent them.
Any violation may result in immediate suspension or termination of your account, removal of content, and forfeiture of any fees or payments made. We reserve the right to remove any content or user submissions at any time, with or without notice. You agree to compensate Analyttica for all losses, damages, costs, or expenses arising from such actions. Analyttica also reserves the right to initiate legal proceedings if necessary.
16. Representations & Warranties by Analyttica
- Third-party content: Analyttica is not responsible for third-party content accessible through the Services, including opinions, advice, statements, or advertisements. You agree to bear all risks associated with accessing or relying on such content. Analyttica disclaims all liability for any loss, damage, cost, or expense arising from your dealings with third parties.
- Third-party links and gateways: Our platform may contain links to third-party websites, services, or payment gateways that are not owned or controlled by Analyttica. We disclaim responsibility for the content, privacy policies, practices, or terms of any third-party site or service. You are encouraged to review the applicable terms and privacy policies before engaging with them.
- Accuracy and confidentiality of data: Analyttica does not guarantee the accuracy, validity, or reliability of any information accessed or shared on the platform. Data cases, information, and analyses are provided for educational purposes only; we do not guarantee their authenticity or real-world applicability. Analyttica does not guarantee the confidentiality of any information shared on the platform and disclaims liability for any unauthorized disclosure.
- Sharing of personal data: Analyttica does not share personally identifiable information with third-party companies or entities without your consent, except where required by law or with agents acting on our behalf. We may disclose such information in response to legal requests (e.g., court orders or subpoenas).
- Marketplace & submitted content disclaimer: The Services function as a marketplace or content-sharing platform. Analyttica does not endorse, verify, or guarantee the accuracy, quality, or legality of any content submitted by users, instructors, or other contributors. Reliance on such content is at your own risk.
- Beta & Trial Features: Certain features or functionalities may be offered as “Beta” or trial features. These are provided “as is” and may contain bugs or errors. We disclaim liability for any issues arising from their use.
17. Code of Conduct
Users must:
- Register only one account with accurate details.
- Submit only their own work unless collaboration is explicitly allowed.
- Avoid circulating solutions or cheating.
- Not spam, introduce malware, or use bots/scripts.
- Respect others; do not harass or impersonate.
- Respect community content—do not share other users’ posts outside these spaces without permission.
Violations may result in content removal, account suspension, or legal action.
18. Warranty Disclaimer
To the fullest extent allowed by law, Analyttica provides the Services “as is” and disclaims all warranties (express or implied), including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted, error-free service.
- No Liability for AI Outputs: Analyttica disclaims liability for any outcomes generated by AI, ML, or data analytics tools on the platform. You assume all responsibility for decisions made based on these insights.
- Educational Purposes: Content on the platform (courses, exercises, or data sets) is for educational purposes only. Analyttica does not provide professional, financial, legal, or medical advice, and no material on the Services should be interpreted as such.
Some jurisdictions do not allow the exclusion of implied warranties, so the above exclusions may not fully apply to you.
19. Dispute Resolution & Arbitration
19.1 Binding Arbitration
All disputes must be resolved through binding arbitration, rather than court, under the rules of the American Arbitration Association (AAA) if you reside outside India, or under the Arbitration and Conciliation Act, 1996 if you reside in India.
19.2 No Class Actions
You waive the right to participate in class actions or consolidated proceedings. If a court finds this unenforceable, this entire arbitration provision is void.
19.3 Small Claims Court
Either party may bring qualifying claims in small claims court in Wilmington, Delaware, USA, or Bangalore, Karnataka, India.
19.4 Location & Language
Arbitration for non-Indian users is in Wilmington, Delaware; for Indian users, it is in Bangalore, Karnataka, conducted in English.
19.5 Court Jurisdiction
If arbitration is invalid, disputes proceed in courts located in Delaware or Bangalore, at Analyttica’s discretion.
20. Limitation of Liability
To the fullest extent permitted by law, Analyttica, its officers, employees, or agents are not liable for any indirect, incidental, special, or consequential damages (e.g., lost profits, data). Our total liability for claims is capped at the amount you paid for Services in the prior 12 months, if any.
Some jurisdictions do not allow such limitations, so they may not fully apply to you.
21. Indemnification
You agree to defend, indemnify, and hold harmless Analyttica, its affiliates, officers, employees, and agents from any claims, damages, or losses (including legal fees) arising out of:
- Your use of the Services or actions under your account.
- Your violation of these Terms or related policies.
- Infringement of third-party rights by your content.
- Any data or content you upload that violates privacy or other legal rights.
22. Force Majeure
Neither party is liable for delay or non-performance caused by events beyond reasonable control (e.g., natural disasters, war, government orders, riots, strikes, or pandemics).
23. Assignment
You may not assign or transfer these Terms or your rights/obligations without our written consent. Analyttica may freely transfer or assign these Terms at its discretion.
24. Severability & Waiver
If any portion of these Terms is deemed unenforceable, the remainder remains in effect. Failure to enforce any provision does not waive our right to enforce it later.
25. Feedback & User Ideas
By submitting feedback or suggestions, you grant Analyttica a perpetual, royalty-free, worldwide license to use and commercialize such input. We are not obligated to keep user ideas confidential or provide compensation.
- Unsolicited Ideas: You agree that if you send us unsolicited ideas (e.g., new promotions, products, or services), we may use them without restriction or compensation. You are responsible and liable for anything you submit.
26. Entire Agreement
These Terms, along with our Privacy Policy and Intellectual Property Policy, constitute the entire agreement regarding your use of the Services and supersede any prior agreements or understandings.
